El Alto Tribunal ha dictaminado mediante sentencia de la Sala de lo Contencioso Administrativo que las parejas de hecho son equiparables a los matrimonios a los efectos de poder obtener el título de familia numerosa.
El Supremo ha examinado el caso de una pareja de hecho inscrita en el registro autonómico de uniones de hecho, y padres de tres hijos comunes, a quien la Consejería de Familia de la Junta de Andalucía en el año 2019, concedió el título de familia numerosa de categoría general fijando como beneficiarios al padre y a los hijos, pero no a la madre.
El motivo de no incluir a la madre fue la aplicación de la Ley 40/2003, de 18 de noviembre, de Protección a las Familias Numerosas, que define a la familia numerosa en su artículo 2.1 como “…la integrada por uno o dos ascendientes con tres o más hijos, sean o no comunes” y en su apartado 3 expone que “a los efectos de esta ley, se consideran ascendientes al padre, a la madre o a ambos conjuntamente cuando exista vínculo conyugal y, en su caso, al cónyuge de uno de ellos”.
La pareja interpuso recurso contencioso administrativo ante el Juzgado de lo Contencioso-Administrativo de Sevilla, estimando dicho recurso y condenó a la administración andaluza a reconocer también a la madre la condición de miembro de familia numerosa. Y esto es así porque procedía una interpretación de la Ley de Familias Numerosas acorde a la realidad social y con el precepto que dirige a los poderes públicos el artículo 39.1 de la Constitución de proteger social, económica y jurídicamente a la familia, por lo que debía extenderse la denominación de «vínculo conyugal» a las parejas de hecho.
Sin embargo, la Junta de Andalucía recurrió la sentencia al Supremo al considerar que la Ley andaluza de Parejas de Hecho iguala matrimonio y uniones de hechos, con las limitaciones que pueden resultar de una normativa estatal, que en este caso entienden que era la Ley de Familias Numerosas.
El Tribunal Supremo señaló finalmente que la cuestión es establecer el alcance del concepto de ascendiente a los efectos de la Ley de Familias Numerosas, y lo que se discute es si puede incluirse como beneficiario en el título de familia numerosa a los dos progenitores no unidos por vínculo matrimonial.
Señala el Tribunal Supremo que “al ser esa familia la base del sistema de familias numerosas y la función del vínculo conyugal la expuesta, no cabe excluir a la unión de hecho de los progenitores, ahora bien, ese hecho, para que produzca efectos jurídicos debe tener publicidad formal, de ahí que deba inscribirse en un registro de uniones de hecho. Con esa inscripción hay garantía formal de la realidad de una convivencia more uxorio tratándose de convivientes que no desean contraer matrimonio”.
El Supremo también expone que “sería deseable una reforma legal”, ya que habría dado seguridad jurídica y un régimen legal unitario en toda España. Las Comunidades Autónomas tienen espacio jurídico para reconocer la condición de beneficiarios a los dos convivientes ejerciendo su competencia en materia de asistencia social dentro de las bases de la normativa estatal o en la ejecución de la misma.
Por lo tanto, la aplicación del artículo 2.3 de la Ley de Protección de Familias Numerosas no excluye que tengan la consideración de ascendientes los dos progenitores aun cuando no haya vínculo conyugal, pero esté inscrita la pareja de hecho en un registro de uniones de hecho. El único requisito es la inscripción en un registro de uniones de hecho para acreditar la convivencia.
